Terms of Service

1. Accepting these terms

These Terms of Service apply when you access or use Fresh Quote Calculator. By creating an account, checking the acceptance box, or using the service, you agree to these terms and the Privacy Policy. If you use the service for a company, you confirm that you are authorized to accept these terms for that company.

2. Accounts and company workspaces

You provide an account email, password, contact and business profile details, industry, and service setup. New accounts must confirm their email. Keep your sign-in credentials private, use accurate account information, and tell us promptly if you believe someone has used your account without permission. The company owner is responsible for managing the company subscription and access by company members.

3. What the service does

Fresh Quote Calculator provides a service-job calculator, company setup and pricing defaults, estimate history and exports, client records, estimate emails and customer response links, business insights, AI-assisted estimate drafts and pricing guidance, and company branding. Customer photos and custom CRM colors are available to eligible Max workspaces. Features and access depend on the plan and the company’s verified subscription status.

Estimates, cost calculations, tax amounts, profit projections, AI drafts, and pricing suggestions depend on information and assumptions you provide. They may be incomplete or wrong and are not accounting, tax, legal, safety, construction, or other professional advice, a guaranteed price, or a promise that a job will be profitable. Review and verify every estimate before relying on it or sharing it with a customer.

4. Your content and your responsibilities

You retain your rights to the company, customer, estimate, logo, photo, and other information you submit. You authorize Fresh View Home Solutions and the providers described in the Privacy Policy to host, store, transmit, and process that content as needed to provide the features you request.

You are responsible for having permission to enter customer or other people’s information, upload photos, send estimates, and share estimate links. Share customer links carefully: anyone who has a valid link can view the customer-facing estimate and submit its one-time approve or decline response. Do not include information in an estimate or photo that you are not authorized to share.

5. AI features

AI Estimate Builder returns an editable draft; it does not save or send the draft unless you choose to transfer it to the calculator and then save or send it. The Pricing & Business Assistant provides guidance and does not change calculator values. AI systems can produce inaccurate, outdated, or unsuitable content. Check all outputs independently, and do not rely on them for exact measurements, live market prices, legal or tax determinations, or safety decisions.

6. Plans, trials, and payment

Pro is $29.99 USD per month or $199 USD per year. Max is $49.99 USD per month or $399 USD per year. Monthly subscriptions have no free trial and are charged immediately through Stripe Checkout. Eligible annual checkouts include a 14-day free trial. Stripe Checkout requires a payment method before the trial begins. No subscription charge is due during the trial; unless the owner cancels before the trial ends, the selected annual amount is charged when the trial ends. If Stripe has no payment method at trial end, Stripe is instructed to cancel the subscription.

An annual subscription renews annually, and a monthly subscription renews monthly, unless canceled. The company owner can manage or cancel through the Billing page and Stripe Customer Portal. The effective cancellation date and billing status are determined by Stripe and shown in Billing; a cancellation scheduled for the end of a paid period does not take effect early.

A free trial is limited by the company and its verified owner email. After Stripe reports that a subscription has ended, the same company and verified owner email cannot start another free trial for 90 days. The Billing page shows the eligibility date. During that period, the owner may start a paid subscription without a trial.

Stripe processes checkout and payment-method information. Fresh Quote stores subscription and payment status needed to manage access; it does not provide a payment card number field in the app. For billing questions, contact Fvbusinesssolutions@gmail.com. 7. Acceptable use

Use the service only for lawful business purposes and in ways you are authorized to use. Do not interfere with the service, attempt to access another company’s workspace, misuse or probe its security, submit malicious code, abuse AI or email features, or upload content that you do not have rights to use. Do not use generated material as a substitute for your own review and professional judgment.

8. Intellectual property

Fresh View Home Solutions retains its rights in Fresh Quote Calculator, its software, design, and branding. Subject to these terms and your active plan, we give you a limited, non-exclusive, non-transferable right to use the service for your business. You give us only the limited permission needed to operate the service with your content; this does not transfer ownership of your content to us.

9. Availability, suspension, and termination

The service may be unavailable, changed, or interrupted, including when a required third-party provider is unavailable. We do not promise uninterrupted operation or a particular uptime. We may suspend or end access if an account creates a security or service risk, materially violates these terms, or no longer has an eligible subscription. You may stop using the service and the owner may cancel the subscription through Billing. Access follows the subscription status verified by Stripe.

10. Disclaimers and limits of liability

To the extent permitted by law, the service is provided “as is” and “as available,” without a promise that it will meet every business requirement or that estimates and AI output will be accurate. Nothing in these terms removes a right or remedy that cannot legally be excluded.

To the extent permitted by law, Fresh View Home Solutions will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or loss of profits, revenue, business opportunity, or data arising from use of the service. To the extent permitted by law, our total liability for claims relating to the service will not exceed the subscription fees you paid to us for the service in the 12 months before the event giving rise to the claim. These limits do not apply where applicable law does not allow them.

11. Governing law and disputes

Washington State law governs these terms, without regard to conflict-of-law rules. Subject to mandatory rights that apply to you, disputes relating to the service may be brought in state or federal courts located in Washington State.

12. Changes and contact

We may update these terms as the service or its requirements change. The effective date above identifies the current version. We will post an updated version here; continued use after an update takes effect means you accept the revised terms to the extent allowed by law.
